1. About These Terms

These Terms of Service ("Terms") govern your use of the website DeelayHelp.com ("Website") and the services provided by Smart Solution, UAB (registration code: 305644774), operating under the brand name DeelayHelp.com, with registered address at Architektų g. 152B, Vilnius, Republic of Lithuania ("we", "us", "our", "DeelayHelp"). By using our Website or submitting a claim, you agree to be bound by these Terms.

2. Our Services

DeelayHelp.com provides flight compensation claim services on behalf of air passengers under EU Regulation 261/2004 (EC) and related legislation. Our services include evaluating eligibility, preparing and submitting claims to airlines, and pursuing compensation through available legal channels on your behalf.

We act as your representative and authorised agent in dealing with the relevant airline(s) regarding your compensation claim. We are not a law firm and do not provide legal advice.

3. Eligibility

To use our services, you must:

  • Be at least 18 years of age, or have parental/guardian consent.
  • Be the passenger named in the claim, or have authorisation to act on behalf of the passenger.
  • Provide accurate and truthful information in your claim submission.
  • Not have already received compensation for the same flight disruption, nor have assigned the claim to another party.

4. How Our Service Works

When you submit a claim through our Website:

  1. You provide us with your flight and personal details.
  2. We assess the eligibility of your claim based on EU261/2004.
  3. If eligible, we pursue your claim with the airline on your behalf.
  4. Upon successful resolution, we deduct our fee and transfer the remaining compensation to you.

By submitting a claim, you authorise DeelayHelp to act as your representative and to communicate with the airline(s) on your behalf. This authorisation remains in effect until the claim is resolved or you withdraw it in writing.

5. Fees and Payment

Our service operates on a "no win, no fee" basis:

  • If your claim is successful, we charge a commission of 25% of the compensation amount (plus applicable VAT).
  • If your claim is unsuccessful, you owe us nothing.
  • There are no upfront fees, hidden charges, or cancellation penalties.

If legal proceedings are necessary to pursue your claim, an additional fee of up to 15% may apply to cover legal costs. You will be informed before any legal action is taken on your behalf.

Payment of your compensation (minus our fee) will be made via bank transfer to the account you provide. You are responsible for ensuring your bank details are correct.

6. Your Obligations

By using our service, you agree to:

  • Provide accurate, complete, and truthful information.
  • Respond to our requests for additional information or documents in a timely manner.
  • Not pursue the same claim independently or through another company while we are working on it.
  • Inform us immediately if you receive any direct communication or payment from the airline regarding your claim.
  • Not provide false or fraudulent information.

7. Claim Withdrawal

You may withdraw your claim at any time by notifying us in writing at support@deelayhelp.com. If compensation has already been obtained or an agreement reached with the airline at the time of withdrawal, our fee remains due.

8. Limitation of Liability

While we make every effort to successfully pursue your claim, we cannot guarantee a specific outcome. The success of a claim depends on factors including the airline's response, the specific circumstances of the flight disruption, and applicable laws.

DeelayHelp shall not be liable for any indirect, consequential, or incidental damages arising from or related to our services, except in cases of gross negligence or wilful misconduct on our part.

Our total liability to you shall not exceed the amount of compensation obtained for your claim.

9. Intellectual Property

All content on this Website, including text, graphics, logos, icons, images, and software, is the property of DeelayHelp.com and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our written permission.

10. Privacy

Your personal data is processed in accordance with our Privacy Policy. By using our services, you consent to the processing of your personal data as described therein.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Lithuania. Any disputes arising from or relating to these Terms shall be subject to the jurisdiction of the courts of Lithuania.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of our services after any changes constitutes acceptance of the updated Terms.
